3. Service Terms & Responsibilities

3.1 Client Obligations

By using our services, you agree to:

  • Provide accurate shipment details, including cargo description, weight, dimensions, and special handling requirements.
  • Ensure compliance with local and international trade laws when shipping goods.
  • Pay all applicable fees, taxes, and duties related to freight, customs, and logistics services.
  • Adhere to restrictions on prohibited or dangerous goods (see Section 6).

3.2 Bromley Logistics Obligations

  •  Handling cargo with care, professionalism, and security.
  •  Ensuring customs compliance and accurate documentation.

4. Pricing & Payment Terms

4.1 Rates & Charges – Shipping rates are based on weight, volume, destination, and shipping method. Additional charges may apply for customs duties, storage, and special handling.

4.2 Payment Terms – Invoices must be paid within the agreed Payment Terms from the date of issuance. Late payments may incur interest charges or service suspension.

4.3 Taxes & Duties – Clients are responsible for all applicable customs duties, VAT, and local government fees.


5. Cargo Liability & Insurance

5.1 Limited Liability – While we take every precaution to protect your cargo, Bromley Logistics Limited is not responsible for damages, loss, or delays caused by unforeseen events (e.g., natural disasters, customs holds, strikes).

5.2 Cargo Insurance – Clients are encouraged to purchase freight insurance for additional protection. We can assist in arranging cargo insurance upon request.


6. Prohibited & Restricted Goods

Certain goods cannot be shipped due to legal, safety, or regulatory restrictions. Prohibited items include:

🚫 Illegal substances, narcotics, counterfeit goods
🚫 Explosives, firearms, and hazardous materials (unless authorized)
🚫 Perishable goods without proper storage requirements
🚫 Live animals or plants without proper documentation

Clients must declare restricted items and provide necessary permits or certifications. Failure to comply may result in shipment rejection or legal penalties.


7. Delivery Terms & Force Majeure

7.1 Delivery Timelines

We strive to meet agreed delivery schedules, but we are not liable for delays beyond our control, including:

  • Port congestion, customs delays, carrier disruptions
  • Extreme weather, natural disasters, political instability
  • Acts of war, terrorism, pandemics, or strikes

7.2 Force Majeure Clause

If a force majeure event affects service performance, we will:

  • Notify clients immediately about potential delays.
  • Work to minimize disruptions and find alternative solutions.
  •  Resume normal operations as soon as conditions allow.

8. Claims & Dispute Resolution

8.1 Filing Claims – Claims for lost, damaged, or delayed shipments must be submitted in writing within 7 days from the delivery date.

8.2 Dispute Resolution – Any disputes will first be resolved through negotiations. If unresolved, disputes may be subject to arbitration or legal proceedings in Kenyan Courts.


9. Intellectual Property & Website Use

9.1 Website Content – All content, trademarks, and materials on bromleylogisticsltd.com are owned by Bromley Logistics Limited. Unauthorized use, reproduction, or distribution is prohibited.

9.2 User Data & Privacy – By using our website, you consent to our Privacy Policy regarding data collection and usage.
